Sigfyn operates a website https://www.sigfyn.com and a mobile application accessible on smartphones, tablets, desktops, and laptops, collectively referred to as the "Platform" or "Application". The Platform enables you (hereinafter referred to as "You," "you," "your," or "User") to track, save, and grow your wealth by consolidating your entire financial life, including investments, loans, credit cards, and taxes, into a single app. By accessing, visiting, or using our Platform, you agree to comply with and be bound by these Terms and Conditions (the "Terms"). If you do not agree to all of these Terms, you may not use or access the Services or Application in any manner.

Who We Are

The services under the Sigfyn brand are provided by different legal entities based on the nature of the service. The entity responsible for processing your personal data depends on the service you use.

1. Sigfyn Investment Advisors Private Limited

•Nature of Service: This entity operates as a SEBI-registered Investment Advisor and offers investment advisory services, wealth management, and financial planning services to users.

•Data Handling Responsibility: When you engage with our investment advisory services, your data is processed and managed by Sigfyn Investment Advisors Private Limited.

2. Sigfyn Financial Services Private Limited

•CIN: U72900KA2021PTC151908

•Nature of Service: This entity is AMFI registered mutual fund distributor. It uses MF Central to create a consolidated view of your existing mutual funds portfolio and enables you to invest in mutual funds.

•Data Handling Responsibility: When you use our MF Central to view your external mutual funds, invest in regular mutual funds, your data is processed and managed by Sigfyn Financial Services Private Limited.

3. Sigfyn Technologies LLP

•LLPIN: ACM-1509

•Nature of Service: This entity is responsible for the technology platform, including the development, maintenance, and infrastructure of the Sigfyn app and website. It also handles technical operations such as support, analytics, and security infrastructure.

•Data Handling Responsibility: When you use our mobile app, website, or platform features, your data related to platform usage, device information, and interaction data is processed and by Sigfyn Technologies LLP.

Terms of Use

By using the Platform, you agree to:

1. Provide accurate and complete information as required for registration, KYC, and service utilization. 2. Keep your account credentials confidential and notify us immediately of any unauthorized access.3. Use the Platform only for lawful purposes in accordance with applicable laws.4. Ensure that your transactions comply with Income Tax Act, Anti-money laundering laws, and other applicable regulations

Sigfyn reserves the right to suspend or terminate your account if any suspicious, fraudulent, or unlawful activity is detected.

Third Party Servies

Our Platform may link to third-party websites or services (such as Mutual Fund Companies, Banks, or Payment Gateways). Sigfyn does not control or endorse third-party content and is not liable for any loss or damage arising from interactions with third parties.

Limitation of Liability

Sigfyn, its directors, employees, or partners shall not be liable for:

1. Any direct, indirect, incidental, or consequential damages arising from your use of the Platform.2. Loss of data, profits, or investment performance due to reliance on our services. 3. Any third-party services or interactions.

Refund and Cancellation

1. In case of a failed mutual fund transaction, refunds will be processed within 6-7 business days to your registered bank account. 2. Once mutual fund units are allotted, transactions cannot be cancelled. Withdrawal requires a redemption request as per AMC policy.

Data Privacy and Protection

By using our Platform, you agree to the processing of your personal data as outlined in our Privacy Policy available at www.sigfyn.com/privacy-policy . We use third-party services such as Google Analytics and Microsoft Clarity to improve user experience. These services may collect data like session activity, device information, and location data.

Dispute Resolution

Any dispute arising under these Terms shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, India.

Governing Law

These Terms are governed by and construed in accordance with the laws of India . Any legal proceedings shall be exclusively brought in the courts of Bangalore, India.

Intellectual Property Rights

All content, designs, features, and functionalities available on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of Sigfyn or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, publish, or create derivative works from any material available on the Platform without obtaining prior written consent from Sigfyn. Unauthorized use of the Platform's content may result in legal action

Disclaimers

All investments are subject to market risks. Read all scheme related things carefully. Past performance is not an indicator of future returns.

Severability

If any provision of these Terms of Use is held to be illegal, invalid or unenforceable under any present or future applicable laws:

1. such provision will be replaced with another, which is not prohibited or unenforceable and has, as far as possible, the same legal and commercial effect as that which it replaces; and 2. the remaining provisions of the Terms of Use will remain in full force and effect and will not be affected by the illegal, invalid, or unenforceable provision or by its severance here from.

Waiver

Any failure on the part of Sigfyn to require performance of any provision of these Terms of Use shall not affect its right to full performance thereof at any time thereafter, and any waiver by Sigfyn of a breach of any provision hereof shall not constitute a waiver of a similar breach in the future or of any other breach.

Force Majeure Event

Company shall not be liable for any failure to perform any of its obligations under these terms and conditions or those applicable specifically to its products/services, and in such case, its obligations shall be suspended for so long as the Force Majeure event continues. “Force Majeure Event” means any event, due to any cause beyond the reasonable control of Company, including without limitations, unavailability of any communication systems, breach, or virus in the digital processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, lockdown, computer hacking, unauthorised access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc.

Notices

All notices from the Company will be served by email to your registered email address or by general notification on the Platform. Any notice provided to Sigfyn pursuant to the Terms of Use should be sent to contact@sigfyn.com

Changes to Terms
